Introduction
These Terms and Conditions ("Terms") govern access to and use of the MoKont application ("MoKont", "the Platform", "the Service"), owned and operated by Trivora Ltd, Company Registration No. C26231133, registered at 220, Orange Blossom, Splendid View, Albion, Mauritius.
MoKont is an online invoicing platform designed to support registered small and medium-sized businesses in Mauritius in creating, managing, and issuing client invoices.
Eligibility
2.1 MoKont is available to registered businesses operating in Mauritius, as well as unregistered businesses at MoKont's discretion.
2.2 Users may include business owners (including sole traders), accountants, and employees authorised by a registered business.
2.3 During registration, users must accurately state their role within the business.
2.4 You warrant that the business is legally registered (where applicable), you are authorised to act on behalf of the business, and all information provided is accurate and complete.
Account Registration & Responsibilities
3.1 Users must create an account to access the Platform.
3.2 You are responsible for maintaining confidentiality of your login credentials, all activities that occur under your account, and ensuring only authorised individuals access your account.
3.3 MoKont reserves the right to suspend or terminate accounts that provide false information, breach these Terms, engage in unlawful or fraudulent activity, or fail to maintain an active paid subscription following the trial period.
Description of Services
4.1 MoKont provides the following tools and features:
4.2 MoKont does not provide tax, accounting, or legal advice; guarantee payment of issued invoices; or act as a financial institution.
Free Trial & Subscription Model
5.1 Freemium Access
MoKont offers a free trial allowing a maximum of five (5) clients, a maximum of five (5) invoices, valid for one (1) month from registration. After exceeding these limits or at the end of the trial period, users must subscribe to continue using the Service.
5.2 Paid Subscription
5.2.1 Paid subscriptions are billed monthly or annually, as selected at the time of purchase.
5.2.2 Payment is processed automatically via debit or credit card. By subscribing, you authorise automatic recurring payments and accept any fees that may be charged by your card provider.
5.2.3 Failure to process a payment may result in suspension of access, restriction of invoice creation, or account termination following reasonable notice.
5.2.4 Subscription fees are non-refundable except where required by applicable Mauritian law. MoKont reserves the right to revise pricing with reasonable prior notice.
Payment Processing
MoKont may integrate with third-party payment gateways, including MIPS (mips.mu). Payment transactions are subject to the terms of the applicable third-party provider. MoKont does not store full debit or credit card details and is not responsible for payment processing errors, gateway outages, or third-party service disruptions.
Data & Privacy
7.1 MoKont stores financial and business data including client names, contact details, invoice details, and business-related financial records.
7.2 MoKont does not collect or store National ID numbers, passport numbers, or individual tax identification numbers (unless voluntarily entered by users within invoices).
7.3 All data is handled in accordance with the Mauritius Data Protection Act 2017. Users remain the data controller of their client information; MoKont acts as a data processor.
7.4 Upon termination, users may request a data export within a specified period. Data may be deleted after a reasonable retention period, and restoration may be possible within a defined timeframe subject to applicable fees.
User Responsibilities
You agree not to use MoKont for any unlawful purpose, issue fraudulent invoices, upload malicious software, attempt to disrupt platform functionality, or reverse engineer any part of the software.
You are solely responsible for the accuracy of all invoice information, compliance with Mauritian tax regulations, and maintaining proper business records.
Intellectual Property
9.1 All software, design, branding, and platform content remain the exclusive property of Trivora Ltd.
9.2 Users retain ownership of their business data, client information, and uploaded logos and branding assets.
9.3 By uploading content to MoKont, users grant Trivora Ltd a limited, non-exclusive licence to use that content solely to operate and deliver the Service.
Service Availability
MoKont aims to provide continuous platform availability but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, updates, technical issues, or failures of third-party services.
Support
MoKont provides email-based customer support, FAQ and troubleshooting resources, and phone follow-up at MoKont's discretion. Support is provided during standard Mauritian business hours unless otherwise stated.
Limitation of Liability
12.1 To the maximum extent permitted by law, Trivora Ltd shall not be liable for loss of profits or business revenue, indirect or consequential damages, data loss caused by user negligence, or actions of unauthorised persons accessing an account.
12.2 Trivora Ltd's total liability shall not exceed the equivalent of six (6) months of subscription fees paid by the user preceding the claim.
Indemnity
You agree to indemnify and hold harmless Trivora Ltd, its officers, directors, and employees against any claims, losses, or damages arising from your misuse of the Platform, breach of these Terms, or violation of applicable law.
Termination
14.1 Users may cancel their subscription at any time through their account settings.
14.2 MoKont may suspend or terminate an account for non-payment, breach of these Terms, or suspected fraudulent activity.
14.3 Upon termination, access to the Platform will cease and data export may be permitted for a limited period.
Amendments
MoKont reserves the right to update these Terms at any time. Users will be notified of material changes via email or in-app notice. Continued use of the Service following notification constitutes acceptance of the updated Terms.
Governing Law & Jurisdiction
These Terms are governed by the laws of Mauritius. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius.
